Terms of Service

1. Agreement
These Terms of Service (“Terms”) govern your use of BuildMyPrompt (https://buildmyprompt.productstack.com.au), operated by Luminary AI (ABN 44974425746) from New South Wales, Australia (“we”, “us”, “our”). By accessing or using the service you agree to these Terms and our Privacy Policy. If you do not agree, do not use the service.2. Service description
BuildMyPrompt is an AI-powered prompt generation service. You enter a goal in plain English; the service produces a structured prompt you can use in other AI tools. Features may include preview interpretation, domain-specific generation (content, image, code, research), optional Target AI optimisation, in-app prompt history, CSV export on paid plans, and an optional MCP connector (remote API) for signed-in users to generate prompts from compatible third-party clients. The service uses third-party AI providers via OpenRouter. Availability and features may change with notice where required.3. Eligibility and access
You must be at least 18 years old and able to form a binding contract. The public marketing site is available to visitors. Access to the prompt generator and related app features requires a signed-in account, an active paid subscription, or other access we grant. We may refuse, suspend, or revoke access at any time for breach of these Terms or operational reasons.4. Early access feedback
If you participated in our early access program, feedback you submitted may still be used to improve the product and in our marketing (e.g. on the website), typically without identifying you.5. Accounts and authentication
You may sign in via email magic link, Google sign-in where available, or OAuth when connecting an MCP client (e.g. via WorkOS AuthKit). MCP sign-in uses the same account email as the web app; you are responsible for OAuth sessions on connected clients. When we send you a magic link: This link can only be used once. After you sign in, it will not work again. This link is unique to you. Do not share it with anyone — anyone with the link could sign in to your account. You are responsible for keeping your account secure. One person per account; do not share credentials. You must provide accurate information. Use of the service after signing in requires explicit acceptance of these Terms, our Privacy Policy, and our Disclaimer; we record the version accepted and the time of acceptance.6. Free tier
Without a paid subscription: you may generate one (1) prompt per IP address or device before providing an email; after that, email sign-in is required. Authenticated free users may generate up to ten (10) prompts per month (reset at the start of each calendar month in Australia/Sydney). Goal input is limited to 500 characters on the free tier. This monthly allowance applies across the web app and MCP combined — a single shared pool. Free-tier prompts are saved to your private prompt bank (encrypted at rest). Free users may browse saved prompts on the in-app History page but cannot delete records or download CSV export. IP and device gate records expire after 30 days.7. Paid plans and usage limits
Paid subscriptions are offered as Creator, Pro, and Max. Prices are in Australian dollars (AUD). For Australian customers, displayed prices are GST-inclusive where GST applies; tax invoices include our ABN (44974425746).- Creator: AUD $9/month or AUD $89/year — up to 40 prompt generations per billing month, saved prompt library cap 100, goal input up to 1000 characters.
- Pro: AUD $25/month or AUD $249/year — up to 100 prompt generations per billing month, saved prompt library cap 250, goal input up to 1000 characters.
- Max: AUD $49/month or AUD $489/year — unlimited prompt generations per billing month, saved prompt library cap 500, goal input up to 1000 characters.
8. Prompt history library
Authenticated users’ generated prompts may be saved to a private prompt bank (stored via Supabase, encrypted at rest), subject to a per-plan cap: Creator 100, Pro 250, and Max 500 saved records for active paid subscribers. Paid subscribers may browse, copy, share, and delete saved prompts on the History page and download CSV export from that page. Free-tier users may browse saved prompts on the History page but cannot delete records or download CSV export. Former paid subscribers may retain read access to saved history after a subscription ends, subject to the library cap for their last paid tier. Records are scoped to your account; we do not expose one user’s prompts to another. Generating a new prompt does not remove earlier saved records for eligible users; each successful generation adds to your library when saving is allowed (unless the cap prevents saving).9. Billing, renewal, and payment card
Monthly plans are billed on the date you subscribe and renew automatically each month on that date. Annual plans are billed in full upfront on the date you subscribe and renew automatically each year on that anniversary. Both continue to renew on your saved card until you cancel. Stripe handles payment processing in Australian dollars (AUD). You must sign in before purchasing a paid plan so the subscription is linked to your account email.Your payment card is stored securely with Stripe to charge renewals and any prorated plan-change charges. Refunds are returned to that same original card (see our Refund Policy).
Displayed prices are GST-inclusive where GST applies. Tax invoices and refund credit notes include our ABN (44974425746). Price changes apply to new billing periods with reasonable prior notice where required by law.
10. Cancellation
You may cancel your subscription at any time from your account billing settings or by contacting us. Nothing in these Terms limits your right to cancel.- Monthly billing: cancellation stops future renewals. There is no refund for the current month; you retain paid access until the end of the paid month, then paid generation entitlements end unless you resubscribe.
- Annual billing: cancellation stops future renewals. Unused months are refunded to your original card under our Refund Policy.
Within 7 days of a payment, if you have generated 5 or fewer prompts in that subscription cycle, you may receive a full refund under our Refund Policy (including via the Request refund button on your upgrade page when eligible).
Saved prompt history may remain viewable after expiry, but new generations follow the limits that apply to your account at that time. These Terms do not limit a consumer’s rights under the Australian Consumer Law — for example, remedies when the service fails to meet consumer guarantees are separate from voluntary cancellation rules.
10a. Plan changes, proration, and cooldown
You may upgrade, downgrade between paid tiers, or switch billing interval (monthly or annual) from your account. All plan changes take effect immediately with proration: upgrades and switches to annual billing charge the prorated difference straight away; downgrades and switches to monthly billing refund the prorated difference straight away to your original card (see Refund Policy).Plan-change cooldown: after a downgrade or a billing-interval switch, your next downgrade or interval switch is locked for 5 business days (Sydney time). Upgrades and cancellation remain available the whole time — cancellation is never withheld, so you can always leave. If your subscription is scheduled to cancel, choosing a lower paid tier removes the cancellation and applies the new plan immediately after you confirm in the app.
11. Refunds
See our Refund Policy for voluntary refund terms. Statutory rights under Australian Consumer Law are not excluded (see section 17).12. Acceptable use
You agree to use BuildMyPrompt lawfully only. You must not: circumvent usage limits or access controls; scrape or reverse engineer the service; upload unlawful, harmful, or infringing content in your goals; harass others; or use generated prompts for illegal purposes. We may refuse to process any goal that does not meet our usage guidelines, including through automated screening. Refused requests are not generated and do not consume your prompt allowance. We may suspend or terminate access for violation. You must not enter sensitive personal information, financial data, or confidential third-party information into the prompt generator.13. Your content and intellectual property
You retain ownership of goals and other content you submit. You grant us a licence to host, process, transmit, and display that content solely to operate and improve the service (including sending goals to AI providers). Subject to third-party AI provider terms, you may use prompts generated for you for personal or commercial purposes. We do not claim ownership of your outputs. Site design, branding, and underlying software remain our property. Third-party trademarks (Google, Stripe, etc.) belong to their respective owners.14. AI-generated content
Outputs are produced by artificial intelligence and may be inaccurate, incomplete, or unsuitable. See our Disclaimer. You are responsible for reviewing outputs before use, especially for professional, legal, medical, financial, or academic purposes. Prompts are processed by an AI model provider operating outside Australia. By using this service you acknowledge and consent to this cross-border processing.15. Disclaimer of warranties
The service is provided “as is” and “as available” without warranties of any kind, to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.16. Limitation of liability
To the maximum extent permitted by law (including the Australian Consumer Law and laws of New South Wales), we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Our total liability for any claim arising from these Terms or the service is limited to the greater of (a) AUD $100 or (b) amounts you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be excluded or restricted under applicable consumer protection laws.17. Australian Consumer Law and NSW consumers
If you acquire the service as a consumer within the meaning of the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), our services come with guarantees that cannot be excluded, including that services will be supplied with due care and skill, be reasonably fit for any purpose you told us about, and be supplied within a reasonable time when no time is set.- If there is a major failure, you may cancel the contract and receive a refund for the unused portion, or receive compensation for any reduction in value of the service.
- If the failure is not major, we will remedy the failure within a reasonable time; if we do not, you may cancel and obtain a refund for the unused portion.
Unresolved consumer complaints may be referred to NSW Fair Trading or the ACCC.
